 为贯彻落实党中央、国务院深化“放管服”改革和优化营商环境的部署,进一步提高本市工程建设项目审批效率,根据《国务院办公厅关于全面开展工程建设项目审批制度改革的实施意见》(国办发〔2019〕11号)和《天津市深化工程建设项目审批制度改革实施方案》(津政发〔2019〕25号)精神,拟定了《市住房城乡建设委关于印发天津市工程建设项目审批流程施工许可阶段并联审批工作机制的通知》(征求意见稿),现对该通知公开征求意见。

'Times New Roman';font-size:21px">为贯彻落实党中央、国务院深化“放管服”改革和优化营商环境的部署,进一步提高本市工程建设项目审批效率,根据《国务院办公厅关于全面开展工程建设项目审批制度改革的实施意见》(国办发〔2019〕11号)和《天津市深化工程建设项目审批制度改革实施方案》'Times New Roman';font-size:21pxfont-family:仿宋_GB2312">(津政发'Times New Roman';font-size:21px">〔2019〕25'Times New Roman';font-size:21pxfont-family:仿宋_GB2312">号)精神,制定工作机制如下:

'Times New Roman';font-size:21pxfont-family:黑体">一、实施原则

'Times New Roman';font-size:21pxfont-family:仿宋_GB2312">将工程建设项目审批流程主要划分为立项用地规划许可、工程建设许可、施工许可、竣工验收四个阶段。按照项目不同类型,实行分段审批、并联办理、交叉进行、告知承诺、限时办结。继续深化'Times New Roman';font-size:21pxfont-family:仿宋_GB2312">施工许可阶段行并联审批改革'Times New Roman';font-size:21pxfont-family:仿宋_GB2312">,减少建设单位多头申报、各部门多头审批,加快'Times New Roman';font-size:21pxfont-family:仿宋_GB2312">建设项目早日开工建设。

'Times New Roman';font-size:21px">施工许可阶段通过由市、区两级施工许可审批部门牵头组织,实行“一家牵头、并联审批、限时办结”,进一步强化并联审批机制,确保本阶段由牵头部门组织协调,'Times New Roman';font-size:21pxfont-family:仿宋_GB2312">相关部门严格按照限定时间完成审批。

二'Times New Roman';font-size:21pxfont-family:黑体">、实施内容及实施部门

'Times New Roman';font-size:21pxfont-family:仿宋_GB2312">施工许可阶段事项包括施工图(联合审图'Times New Roman';font-size:21pxfont-family:仿宋_GB2312">)审查、建设工程质量监督手续办理'Times New Roman';font-size:21pxfont-family:仿宋_GB2312">、建筑工程施工许可证'Times New Roman';font-size:21pxfont-family:仿宋_GB2312">核发。其中,并联办理事项为建设工程质量监督手续办理'Times New Roman';font-size:21pxfont-family:仿宋_GB2312">与建筑工程施工许可证核发'Times New Roman';font-size:21pxfont-family:仿宋_GB2312">。参与施工许可阶段并联'Times New Roman';font-size:21pxfont-family:仿宋_GB2312">办理的'Times New Roman';font-size:21pxfont-family:仿宋_GB2312">部门包括质量监督部门、施工许可审批部门。

取消本市范围内建设工程安全登记,调整为安全资料查验后由工程安全监管部门作事中事后监管。

三'Times New Roman';font-size:21pxfont-family:黑体">、并联审批'Times New Roman';font-size:21pxfont-family:黑体">申报材料

'Times New Roman';font-size:21px">1.'Times New Roman';font-size:21px">“建设工程质量监督手续办理'Times New Roman';font-size:21px">”与“建筑工程施工许可”合并办理申请表;

'Times New Roman';font-size:21px">2.'Times New Roman';font-size:21pxfont-family:仿宋_GB2312">五方责任主体的法定代表人签署的授权书与《建设工程五方主体项目负责人工程质量终身责任承诺书》《建设工程五方主体项目负责人工程安全终身责任承诺书》;

'Times New Roman';font-size:21px">3.'Times New Roman';font-size:21pxfont-family:仿宋_GB2312">依法确定承包人的材料;

'Times New Roman';font-size:21px">4.'Times New Roman';font-size:21pxfont-family:仿宋_GB2312">天津市房屋建筑和市政基础设施'Times New Roman';font-size:21pxfont-family:仿宋_GB2312">工程施工图设计文件审查合格书;

5.'Times New Roman';font-size:21pxfont-family:仿宋_GB2312">用地批准手续;

6.'Times New Roman';font-size:21pxfont-family:仿宋_GB2312">建设工程规划许可证;

7.'Times New Roman';font-size:21pxfont-family:仿宋_GB2312">施工企业主要技术负责人签署的已经具备施工条件意见书。

注:除以上申报材料,'Times New Roman';font-size:21pxfont-family:仿宋_GB2312">申请办理建设工程质量监督手续办理还需提供“'Times New Roman';font-size:21px">危险性较大的分部分项工程清单”,此项申报材料可采用告知'Times New Roman';font-size:21pxfont-family:仿宋_GB2312">承诺方式申请。

未纳入施工图审查范围的项目,实行施工图设计质量告知承诺制和事中事后监管。以建设单位及勘察设计单位出具告知承诺函,对施工图设计质量与消防设计质量作出承诺,以此办理'Times New Roman';font-size:21px">“建设工程质量监督手续'Times New Roman';font-size:21px">”与“建筑工程施工许可证'Times New Roman';font-size:21px">”。

四'Times New Roman';font-size:21pxfont-family:黑体">、办理流程

(一)窗口接件

'Times New Roman';font-size:21pxfont-family:仿宋_GB2312">根据建设项目管辖权限,建设单位持申报材料,到市或区联合审批综合服务窗口进件,通过一张表单'Times New Roman';font-size:21pxfont-family:仿宋_GB2312">进行施工许可并联审批阶段申报,'Times New Roman';font-size:21pxfont-family:仿宋_GB2312">联合审批综合服务窗口工作人员按照职责分工核对申请材料。

(二)窗口受理

窗口接件后,由'Times New Roman';font-size:21pxfont-family:仿宋_GB2312">联合审批综合服务窗口工作人员负责将申请材料即时送达并联审批部门受理窗口。建设单位提交的申请材料齐全且符合法定形式的,应当场受理并出具受理决定书;申请材料不齐全或不符合法定形式的,受理窗口工作人员应一次性告知补正意见,提交综合窗口并向建设单位出具补正材料通知书。

(三)部门办理

建设工程质量监督手续办理'Times New Roman';font-size:21px">、建筑工程施工许可由市或区级工程质量登记、施工许可审批部门合并办理,并在1个工作日内同时发证。

(四)办结出件

'Times New Roman';font-size:21pxfont-family:仿宋_GB2312">各并联审批部门在事项承诺时限内,出具相应批文,由联合审批综合服务窗口通知申请人领取。

五'Times New Roman';font-size:21pxfont-family:黑体">、强化并联审批机制措施

(一)全面落实施工许可阶段并联审批。结合全面深化工程建设项目审批制度改革工作,强化“一口进件、阶段办理、牵头负责、并联审批、一口出件”的并联办理制度,科学合理设计并联事项,切实提高建设项目并联办理率,进一步压缩办理时限,提高办事效率。

(二)深化全市统一的工程建设项目审批管理平台应用'Times New Roman';font-size:21px">。通过市区两级统一的“横向到边,纵向到底” 联合审批系统平台'Times New Roman';font-size:21pxfont-family:仿宋_GB2312">,将施工许可阶段涉及的事项全部纳入平台管理,全程锁控项目信息和办理过程,完善到期预警、超期警示、催办督办、过程纠偏、异常处理等功能。推进市、'Times New Roman';font-size:21pxfont-family:仿宋_GB2312">区两级'Times New Roman';font-size:21pxfont-family:仿宋_GB2312">各相关审批部门和监管部门打通信息共享通道,建立工作协同机制,实现审批流程全公开、审批信息全共享、审批行为全监控。

(三)强化对审批、服务人员的培训管理。要加强对市、区两级审批窗口工作人员培训,要求熟练掌握与业务相关的政策法规和办理流程,以理论考试、窗口实际操作考核方式检验培训效果,提升服务水平。

建设、勘察、设计单位告知承诺函

 

由          (建设单位)承建的          (项目名称),委托                   (勘察、设计单位名称)负责编制勘察设计文件。目前,已完成编制工作并交付建设单位。现对有关情况做出如下承诺:

1. 按照《市住房城乡建设委关于深化施工图第三方审查改革有关工作的通知》规定,本项目不在施工图第三方审查范围内;

2. 本项目严格按照国家法律法规、标准规范进行勘察设计,无违反强制性标准;满足建设工程规划、人防、选址、设计、岩土治理等要求,符合国家颁布的设计文件编制深度,能够满足施工需要,并依法对设计使用年限内工程质量承担相应终身责任;

3. 严格按照消防法规及消防技术标准进行满足施工许可的设计,并依法对消防设计质量承担相应终身责任;

4. 施工图设计文件和告知承诺函已按规定上传至“天津市数字化审图系统”;

5. 无其他违法、违规的行为。

如违反以上承诺内容,我单位自愿承担相应的法律责任及不良信用评估后果。
